Microsoft and Motorola Intensify Litigation Over Intellectual Property

Commercial litigation over intellectual property and patent ownership has been increasing in the last couple of years as the newest technology becomes ubiquitous in various gadgets.

Last year, the phone makers Nokia, based in Finland, and Apple Inc became embroiled in a legal battle when Nokia sued Apple over patents. Apple followed suit by suing HTC Corp, a handset maker. Oracle Corp has filed an intellectual property lawsuit against Google Inc, accusing them of infringing patents with Android phone software.

According to Reuters, this week Motorola Inc filed a countersuit against Microsoft Corp, accusing them of infringing on 16 of its patents. Motorola's intellectual property lawsuit against Microsoft follows a lawsuit brought against them last month by Microsoft.

Microsoft accuses Motorola of infringing on nine of its patents in its smart phones that use Android software. Google developed the Android software, though as noted in the previous paragraph, their patents are also being disputed.

According to Reuters, Motorola said that they would have preferred to enter into "comprehensive licensing negotiations" rather than go down the road of commercial litigation. The complaints by Motorola were filed in federal courts in Wisconsin and Florida.
