Resolving Disputes Over Unfair Competition

At Dunn Lambert, LLC, our employment law litigation attorneys represent employers, employees and former employees in disputes involving trade secrets, restrictive covenants, unfair competition and wrongful termination.

We are prepared to litigate complex disputes over unfair competition. For example:

  • An insurance producer moves from one agency to another, taking her existing book of clients with her. Did she violate the terms of the restrictive covenant?
  • An employee of a corporation launches a new business, based in part on the knowledge gained as a former employee of the corporation. Did he misappropriate trade secrets?

Enforcing Restrictive Covenants, Protecting Trade Secrets

When representing employers, we work to prevent or halt unfair competition. We will take action to enforce the restrictive covenant or non-compete agreement the employee knowingly and voluntarily signed when joining the company. Or we will show how the new venture he or she is involved in is based on our client’s trade secrets, proprietary information or other intellectual property.

Representing Employees and Former Employees

When representing employees or former employees, we work to find a way for our clients to pursue their goals, whether that means working for a competitor, soliciting their former employers’ clients, establishing a business based in part on knowledge obtained at a former place of employment, or utilizing processes claimed to be protected as a trade secret.

We will review any applicable documents, including the restrictive covenant most employees now sign as a condition of employment. Often, we are able to find and capitalize on the holes in these agreements.

Is a restrictive covenant keeping you from making your next career move? Is a former employee leaving and taking your business with him?
