Difference between a remote work and a telework agreement

On Behalf of | Oct 3, 2024 | Business & Commercial Law |

Businesses of all sizes are adapting to different forms of flexible work arrangements. Understanding the distinctions between a remote work agreement and a telework agreement helps companies manage employee expectations and responsibilities effectively.

Remote work agreement

A remote work agreement refers to an arrangement where an employee works full-time from a location outside the employer’s office. In this type of agreement, employees do not need to come into the office regularly and may live in another state or even another country. This setup includes provisions for equipment, communication methods, and productivity expectations.

Many businesses use remote work agreements to allow employees greater flexibility in choosing where to live. Businesses must ensure that remote work agreements comply with state tax and employment laws, especially when employees work out of state.

Telework agreement

A telework agreement usually involves a hybrid model. Employees work from home or another remote location for part of the week but are still required to come into the office regularly. Telework agreements outline specific in-office and remote workdays. This ensures employees maintain a workplace presence while enjoying flexibility.

This model helps maintain office culture and collaboration while giving employees the option to work from home. Employers must clearly define expectations in agreements to avoid disputes over work hours, productivity, and office attendance.

Finding the right balance

The choice between a remote work agreement and a telework agreement depends on a company’s needs and the nature of the job. Each agreement serves different purposes, but both contribute to overall business success.
